The Queensland Government has recently amended the Building Regulation 2006 (Building) and Other Legislation Cladding Amendment Regulation 2018
What it means for you in Queensland!
The change in legislation means that some Building Owners or Body Corporates may be required to register their buildings and complete the combustible cladding checklist. The new ACP disclosure requirements became effective 1st October 2018
All Building Owners or Body Corporates with buildings that are three or more levels (or categorised as Class 2-9 buildings under the Building Code of Australia) and are built or renovated after 1st January 1994, will need to submit a Statutory declaration to the QLD Government confirming whether their buildings have any ACP cladding attached. The key dates and actions are as follows:
29 March 2019
If the Building Owner or Body Corporate is unsure about any ACP being present, they will need to engage an industry professional to determine this. The Building Owner or Body Corporate must register their building if it meets the criteria determined by legislation and complete the combustible cladding checklist (part 1) before the 29th March.
For buildings with no ACP cladding, the Building Owner or Body Corporate must lodge a statutory declaration to this effect and no further action is required.
If the Body Corporate identifies ACP cladding or is unsure then they move to the next stage.
29 May 2019
Building Owner or Body Corporate must engage a Registered Builder to determine if there is nonconforming cladding. The Builder will then need to complete the building industry professional statement (statutory declaration) with the Body Corporate responsible for submitting this declaration in conjunction with the combustible cladding checklist (part 2) prior to 29th May. If the building has non- conforming cladding they are required to move to part 3, otherwise no further action required.
27 August 2019
Building Owner or Body Corporate must engage a fire engineer and register the engineer’s details on the combustible cladding checklist (part 3). The fire Engineer is engaged to complete a fire risk assessment about the safety of the building and if it is determined that the building is unsafe, propose appropriate rectification works.
3 May 2021
The final report which confirms what rectification works are needed must be lodged to the QLD Building & Construction Commission by 3rd May 2021. The commission will then determine how to proceed.

The ACP Risk and Who it affects.
The ABC TV Four Corners programme (bottom left) screened earlier this year provides a great expose on how the problem arose and the dilemma the governments at State and Federal levels have in fixing it.
The Department of Housing and Public Works has released a document covering the guidelines surrounding the current situation. Within the document the extract (bottom right) outlining which buildings must comply with the guidelines. The most at risk and with significant requirements are Hospitals, Commercial Buildings, Multi-tenancy Residential Buildings and Hotels/Hostels.
